All content, analysis, scores, recommendations, and AI-generated outputs are for general fitness and educational purposes only.You acknowledge and agree that:AbMaxx is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
You should always consult a licensed healthcare professional before beginning any fitness, exercise, nutrition, or diet program.
AbMaxx is not responsible for any injury, illness, health complications, or other consequences resulting from your use of the App.
4. Assumption of Risk
Physical exercise and fitness activities involve inherent risks, including but not limited to injury, illness, or other health complications.By using AbMaxx, you voluntarily assume all risks associated with:Performing exercises, routines, or workouts suggested by the App
Following any fitness guidance, recommendations, or scores
Uploading and analyzing body images
You acknowledge that individual results may vary and no specific outcomes are guaranteed.
AbMaxx uses automated artificial intelligence systems to analyze images, generate physique scores, and provide recommendations.You acknowledge that:AI-generated outputs may contain inaccuracies or errors
Scores and analysis are estimates only and should not be relied upon as professional advice
You are solely responsible for how you interpret and act upon any information provided by the App
By uploading photos or images to AbMaxx, you:Confirm that you have the legal right to upload and share those images
Grant AbMaxx a limited, non-exclusive, royalty-free license to process your images solely for the purpose of providing physique analysis and App functionality
Acknowledge that your images will be processed by automated systems
We do not sell, publicly display, or use your images for advertising or marketing purposes.
By using AbMaxx, you agree to:Provide accurate and truthful information
Use the App only for lawful, personal, non-commercial purposes
Not upload content that is illegal, offensive, harmful, or infringes on the rights of others
Not attempt to reverse-engineer, hack, exploit, or interfere with the App, its systems, or security measures
Stop using the App immediately if you experience pain, dizziness, discomfort, or any adverse symptoms
Not rely solely on AbMaxx for health-related decisions
You may be required to create an account to access certain features. You are responsible for:Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately if you suspect unauthorized access or use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
AbMaxx offers paid subscription plans that provide access to premium features.Billing:Subscriptions are billed in advance on a recurring basis (monthly or yearly) through the Apple App Store.
Payment will be charged to your Apple ID account at confirmation of purchase.
Automatic Renewal:Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation:You may cancel your subscription at any time through your Apple ID account settings.
Cancellation will take effect at the end of the current billing period; you will retain access until then.
No refunds will be provided for partial billing periods.
Refunds:All refund requests are subject to Apple's App Store refund policies.
Price Changes:We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle following notice.
AbMaxx may offer promotional or creator codes at our sole discretion.Codes are issued to select partners and have no cash value.
Codes may be revoked, modified, or discontinued at any time without notice.
Codes may not be sold, transferred, or shared without authorization.
All content, software, features, designs, text, graphics, logos, images, and functionality within AbMaxx are owned by us or our licensors and are protected by applicable copyright, trademark, and intellectual property laws.You may not copy, modify, distribute, sell, lease, or create derivative works from any part of AbMaxx without our prior written permission.
To the maximum extent permitted by applicable law, AbMaxx and its owners, operators, affiliates, employees, and agents shall not be liable for:Any injury, harm, illness, or damages resulting from following workout recommendations, fitness guidance, or any content within the App
Errors, inaccuracies, or limitations in AI-generated analysis, scores, or recommendations
Loss of data, unauthorized access, service interruptions, or technical failures
Any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
Our total liability, if any, shall not exceed the amount you paid to use AbMaxx in the twelve (12) months preceding the claim.Use of AbMaxx is at your own risk.
AbMaxx is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.We make no warranties or guarantees that:The App will be error-free, secure, or uninterrupted
Results will be accurate, reliable, or meet your expectations
The App is fit for any particular purpose
Defects will be corrected
You agree to indemnify, defend, and hold harmless AbMaxx, its owners, operators, affiliates, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:Your use or misuse of the App
Your violation of these Terms
Your violation of any rights of another party
Your reliance on any content or recommendations within the App
AbMaxx may integrate with or rely upon third-party services, including but not limited to payment processors and cloud services. Your use of such services may be subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
We reserve the right to modify, update, suspend, or discontinue AbMaxx or any part of its features at any time without prior notice. We are not liable for any changes or interruptions to the App.We may update these Terms from time to time. The "Last Updated" date at the top will reflect when changes were made. Continued use of AbMaxx after any modifications constitutes your acceptance of the updated Terms.
We may suspend or terminate your access to AbMaxx at our sole discretion, without prior notice, for any reason, including but not limited to:Violation of these Terms
